Requirements to Divorce in Oklahoma

When you seek a divorce, there are several aspects that you will need to bear in mind, including:

  • Fault: Oklahoma, like all other states, is a “no-fault” state. Therefore, if one spouse no longer wishes to continue the marriage, he or she can file for divorce without having to elaborate on the reasons why the marriage no longer works.
  • Residency: One spouse must be a resident of the state for at least 6 months, and a resident of the county for at least 30 days before filing for divorce. A petition for divorce will likely be dismissed until these requirements are fulfilled.
  • Waiting Period: Additionally, there is also a waiting period of 10 days before a divorce can be finalized after a spouse files with his or her county. This applies only when children are not involved, however. If there are children involved, the waiting period increases to 90 days.

What Are the Grounds for Divorce in Oklahoma?

Oklahoma recognizes both fault and fault-based divorces. In a no-fault divorce, you would only need to show that you and your spouse are no longer compatible and that there is no chance of reconciliation between you both. For someone to be considered at-fault in a divorce, your spouse’s spouse’s actions or behaviors contributed to the end of the marriage.

Some of these grounds include:

  • Adultery
  • Extreme cruelty
  • Impotence
  • Gross neglect of duty
  • Failure to financially provide
  • Incarceration due to a felony
  • Drug abuse or alcoholism
  • Abandonment of the marriage for at least 12 months
  • A wife is unfaithful during the marriage and becomes impregnated with another man's child
  • Insanity lasting for at least five years
