What Makes a Divorce “Uncontested” in Oklahoma

An uncontested divorce, sometimes called a waiver divorce, requires both spouses to agree on every issue before a decree can be entered. That means full agreement on property and debt division, child custody, child support, and spousal support if applicable. If even one issue remains disputed, the case is treated as contested.

Oklahoma’s only no-fault ground for divorce is incompatibility, codified at Okla. Stat. tit. 43, §101. Incompatibility means the marriage has broken down and can’t be repaired. • Parenting plan and child support computation: Required when minor children are involved. Oklahoma also generally requires both parents to complete a co-parenting class when the ground for divorce is incompatibility.

Oklahoma divides marital property under an equitable distribution standard, meaning the court looks for a fair division rather than an automatic 50/50 split.

How Long an Uncontested Divorce Takes in Oklahoma

Oklahoma law imposes mandatory waiting periods between filing and finalization. For divorces without minor children, the minimum is 10 days. When minor children are involved, the waiting period extends to at least 90 days, even when both spouses are in full agreement. These periods run from the date the petition is filed, not from when documents are completed.
